Compensation:
$150,000+ Plus Incentive Compensation
Responsibilities:
Job Description (Tasks)
- Develop litigation and trademark strategies and communicate them to stakeholders (owner, then Legal Team, concierge, client)
- Drafting of demand letters, responses, pleadings, motions, working with an experienced paralegal
- Federal litigation – trademark, copyright, patent, and related claims (unfair competition) Develop discovery plan, both offensive – to get the evidence needed
- – and defensive – seeing and understanding what we have and what we will need to produce so discovery runs smoothly and proactively
- Depositions and Court Appearances and working with local counsel across the country
- Custom contract drafting focusing on IP-related contracts, including NDAs, License Agreements, EULAs, Master Service Agreements, TOS and Privacy Policies, vendor contracts, and employment contracts (with an emphasis on work product ownership and nondisclosure)
- Trademark analysis, drafting, prosecution
- Trademark clearance searches
- Trademark opposition and cancellation prosecution and defense
- Counseling clients in IP enforcement and litigation matters, especially Cease & Desist practice
- Trademark registration practice – preparing and filing, responding to office actions, appeals
- Counseling clients in IP identification and protection matters, especially trademark
- Custom contract drafting focusing on IP-related contracts, including NDAs, License Agreements, EULAs, Master Service Agreements, TOS and Privacy Policies, vendor contracts, and employment contracts (with an emphasis on work product ownership and nondisclosure)
- Counseling clients in copyright protection matters, especially those involving software and online works
Qualifications:
Must haves:
- Significant understanding of and experience with trademark law, from clearance through litigation. Demonstrated effectiveness through results
- Significant experience and facility with federal litigation in intellectual property cases. Demonstrated effectiveness through results
- Significant experience and facility with TTAB cases, start to finish. Demonstrated effectiveness through results
- Superior legal writing and pride in your work
- Enthusiastic about understanding client needs
- Significant experience and facility drafting, reviewing, and negotiating intellectual property license agreements, End User License Agreements, Terms of Use and Privacy Policies, Master Service Agreements, and other contracts relating to IP
- Likes litigation, fighting for people who are being wronged
Good to have:
- Demonstrated understanding of and experience in copyright law highly desirable
