Whichever level you choose, you will get: 1) Our thoughtful and thorough analysis of the items located and how they relate to you, and 2) Our recommended action, including the recommended tone of the first contact with the trademark user.
- We know that even the best searching is worthless without the analysis and recommendations of someone who knows and cares about your business. That’s why each month, if any items of note are located, we will make a balanced recommendation to you based on your business and your goals with respect to your trademark.
All subscriptions start with a strategy session with you to discuss your goals and develop a Cease & Desist strategy that works for you. Tree and Shrub Subscriptions come with three custom Cease & Desist letters (first Notice Letter, second Cease & Desist letter, final Cease & Desist letter). Tree Subscription comes with a custom Complaint for Trademark Infringement and a custom Notice of Opposition ready to file so we can take enforcement action immediately if needed, with no delay or added cost.
Tree Subscription : One-time onboarding fee of $4,500, then $500/month per trademark
- Search the USPTO Official Gazette (released once a month) to find any similar marks approved for registration while it’s early enough to prevent registration
- Search the USPTO Registry (new applications, new registrations) to find applications and registrations for marks similar to your mark
- Search the Internet (Google®) to identify unauthorized uses of your trademark (first 5 pages of results)
- Search KnowEm® to identify social media handles using your trademark
- A custom series of three Cease & Desist letters ready to send to each infringer located (first Notice Letter, second Cease & Desist letter, final Cease & Desist letter)
- A custom Notice of Opposition to prevent registration of an infringing mark at the USPTO (no filings will be made without your approval).
- A custom Complaint for Trademark Infringement ready to send and/or file for intransigent infringers (no filings will be made without your approval).
- Monthly reporting of results to you.
- Sending out Cease & Desist letters on your behalf, reporting any responses to you, and managing your Cease & Desist actions (sending out each letter in the series if the infringer does not respond adequately).
Shrub Subscription: One-time onboarding fee of $2,500, then $375/month per trademark
- Search the USPTO Official Gazette (released once a month) to find any similar marks approved for registration while it’s early enough to prevent registration
- Search the USPTO Registry (new applications, new registrations) to find applications and registrations for marks similar to your mark
- Search the Internet (Google®) to identify unauthorized uses of your trademark (first 3 pages of results)
- Custom series of three Cease & Desist letters ready to send to each infringer located (first Notice Letter, second Cease & Desist letter, final Cease & Desist letter)
- Monthly reporting of results to you.
- Sending out Cease & Desist letters on your behalf, reporting any responses to you, and managing your Cease & Desist actions (sending out each letter in the series if the infringer does not respond adequately).
Seedling Subscription – One-time onboarding fee of $650, then $250/month per trademark
- Search the USPTO Official Gazette (released once a month) to find any similar marks approved for registration while it’s early enough to prevent registration
- Monthly reporting of results to you.
